There are many different types of construction defects in California. Some are design defects, some are workmanship defects, and some are material defects. Sometimes, the terrain around us, if not properly changed/manipulated can turn into a construction defect later.

California is a state full of different lands and terrains. Regardless of what the ground looks like, if a contractor is set to go on a project, he/she must abide by all proper building procedures to make sure that land will properly hold the structure.

Believe it or not, different soil can cause different problems with building. Some types of soil can lead to construction defects in the form of foundation issues. If there are foundation issues, a home/building is not safe.

Before building begins, thorough testing the soil can help prevent construction defects down the line. To test the soil, you want to get a structural engineer and a geotechnical engineer to conduct the test. The tests will reveal the stability, consistency, and subsurface toxicity of the soil.  Before building, these tests are essential because they will determine if the soil can support a structure in the long term.

If the soil isn’t tested, there is a chance there could be foundation problems in a structure early on and/or way down the line. Structural defects can be reported as a construction defect up to 10 years after the construction was completed.

Here are some defects that can occur fast or slow from soil problems:

  • Cracks in the structure/foundation’s walls
  • Shifting/settling of thfoundation
  • Deterioration of the foundation
  • Water intrusion in the structure/foundation

A developer, contractor, and/or subcontractor can be held liable for these construction defects.  If the soil tests were not done (due to lack of money or carelessness), the developers/contractors will be found at fault as they should have analyzed the quality of the soil.
