After a property is built, sometimes homeowners or homeowner associations find defects in their home. Some defects are minor and cosmetic mistakes while others are larger, more serious construction defects, which can be dangerous and compromise the integrity of the building. The defect itself could lead to even more problems, which could end poorly be very expensive to repair. You don’t want a defect to turn into structural failure, flooding or even a fire.

If you found a construction defect, read your contract and see what it says about defects and what it covers. Also, you may want to reach out to a construction defect attorney right away to let him/her know you may need their help if this problem isn’t easily solved.

You can try to talk out the issue with the contractor. In California, the owner must give the contractor the opportunity to resolve the issue before legal action is taken.

If you talked to the contractor and no resolution occurs, call back that construction defect attorney who has expertise in construction defect claims in California. The attorney can help persuade the contractor into a resolution or work with a neutral third party to help the parties reach an agreement.

If the contractor and homeowner cannot reach an agreement, you may need to file a claim to go to court or file for arbitration.

Is construction defect litigation expensive?  In a contingent fee agreement, you do not pay legal fees unless and until there is a recovery. Other costs of the litigation may be charged to the client but may also be advanced by the law firm and recovered from proceeds of case resolution. Some of the investigation and analysis expenses can also be recovered at trial, assuming the case goes that far.
